1. Data Controller

2. Core Privacy Principle

Beat Motion Studio is an app for iOS and Android for creating beat-synchronized video mixes. All processing of video and audio material takes place exclusively on the user's device. Videos, music tracks and finished exports are never transmitted to Pondstack Software or to any third party. Pondstack Software receives no personal data from the app.

The app contains no advertising libraries, no tracking technologies and no behavioural observation tools. No usage profiles are built. One technical exception is the diagnostics transmission of the Android face detection described in section 9.

Internet connections

The app connects to a server only in the following cases. In none of them is any user content – video, photo, music or export – transmitted.

• Overlay, effect and music packs: When the overlay or music picker is opened, the app downloads an index of the available content, and the packs and tracks the user selects, from pondstack.com. Nothing is sent beyond the request itself. As with any web request, the server technically learns the device's IP address; it is used solely to deliver the requested files and is not combined into profiles.
• Purchase verification (Android only): To determine whether a purchase is still valid (for example after a refund), the app may send the purchased product's identifier and the purchase token issued by Google Play to a verification service operated by Pondstack Software. That service uses them only to query the status of this purchase with Google and returns the result. The token is held in memory only, is not stored and is not logged; it contains no name, e-mail address or payment details. The service is hosted on Cloudflare; it keeps the request's IP address in memory for 60 seconds in order to rate-limit requests, and does not store it permanently. The legal basis is Art. 6(1)(b) GDPR (performance of a contract) together with the legitimate interest in preventing abuse under Art. 6(1)(f) GDPR.
• Face detection (Android only): The Android edition uses Google's ML Kit to analyse clips. The detection itself runs entirely on the device – no images, no detected faces and no features derived from them leave the device. The SDK does, however, transmit technical diagnostics to Google on its own; details in section 9.
• Opening these pages: The links to the privacy policy, terms and help open the device's browser. From that point on, the website's privacy policy applies.

3. Data Processed Locally

Beat Motion Studio processes the following data exclusively on the user's device:

• Video clips: Videos selected by the user from the photo library are processed in memory for motion analysis and video editing. Original files are not modified.
• Audio / music tracks: The song selected by the user is processed locally for BPM detection and beat analysis – on iOS from the Apple Music library, on Android as an audio file the user picks through the system file dialog.
• Project settings: Cut length, export duration, transition style, filters, effects, format, resolution, and text label configurations are stored locally on the device (iOS: UserDefaults, Android: SharedPreferences).
• Exported videos: Finished MP4 videos are saved to the camera roll (photo library) at the user's request.

4. Access to Photos and Videos

Beat Motion Studio requires read access to the user's videos and photos to select material for the mix, and write access to save the finished video mix to the camera roll (iOS) or the gallery (Android).

• Video data is processed exclusively on-device and is not transmitted to external servers.
• Original videos are never modified.
• iOS: Access can be restricted or revoked at any time in Settings under Privacy & Security → Photos → Beat Motion Studio.
• Android: Selection runs through the system photo picker. The app receives access only to the files actually selected and requests no standing permission for the gallery.

5. Access to Music

To select a song for the video mix, Beat Motion Studio accesses the user's Apple Music library on iOS via Apple's MediaPlayer framework; this access is entirely local. On Android there is no access to a music library: the user picks an audio file through the system file dialog, and the app receives that one file only.

• Audio data is processed locally on-device for BPM and beat analysis.
• No audio data is transmitted to external servers.
• On iOS, access can be revoked in Settings under Privacy & Security → Apple Music → Beat Motion Studio. On Android no revocation is needed because no standing permission is granted.

6. Instagram Sharing (Optional)

Beat Motion Studio offers the option to share finished videos directly as an Instagram Story or Instagram Reel. This feature uses Instagram's public interface; no Instagram SDK or Meta Developer Portal integration is used. The same applies to handing a video to Facebook Stories.

• On iOS the video is temporarily placed (max. 5 minutes) in the UIPasteboard and passed to the Instagram app via URL scheme. On Android the Instagram app is granted a time-limited read permission on exactly that one file through a FileProvider; no clipboard is involved.
• The data transfer to Instagram is carried out solely by the Instagram app itself; Pondstack Software is not involved in this process.
• Instagram must be installed on the device to use this feature.
• Data processing by Instagram/Meta is governed by Meta's Privacy Policy.

7. Sharing via the System Dialog (Optional)

Exported videos can be shared with any app via the system's standard share dialog (iOS: UIActivityViewController, Android: ACTION_SEND through a FileProvider) – for example AirDrop, TikTok, WhatsApp, YouTube, or Mail. Pondstack Software has no influence over the data processing by the respective target app or service.

8. In-App Purchases

Beat Motion Studio offers optional in-app purchases (Standard, Pro, Upgrade). Payment processing is handled exclusively by the respective app store operator – Apple StoreKit 2 and the Apple App Store on iOS, Google Play Billing and the Google Play Store on Android. Pondstack Software never receives payment or credit card data from the user. Payment data is processed solely by Apple or Google in accordance with their privacy policies.

To check whether a purchase is still valid, the Android edition may send the purchase token to the verification service described in section 2.

9. Diagnostics and Crash Reports

The app itself contains no crash or diagnostics library. Crash reports arise solely through the operating system, and only where the user has consented:

• iOS: If the user has consented to share diagnostics with Apple, anonymized crash reports may reach the developer via Apple. This can be disabled under Privacy & Security → Analytics & Improvements.
• Android: If the user has consented to send usage and diagnostics data to Google, anonymized crash reports may reach the developer via the Google Play Console. This can be disabled in Android Settings under Google → All services → Usage & diagnostics.

In both cases Pondstack Software receives technical crash logs only, without personal reference.

Face-detection diagnostics (Android only)

To analyse video clips, the Android edition uses Google's ML Kit (face detection module). The model runs entirely on the device. According to Google's own disclosure, the SDK nevertheless transmits technical data to Google:

• device information such as manufacturer, model, operating system version and available hardware accelerators,
• the app's package name and version,
• a per-installation identifier which, according to Google, is not intended to identify a user or a particular device,
• performance metrics, image size and format, and error codes.

Images, videos and detected faces are not transmitted. Transmission is encrypted (HTTPS). Pondstack Software does not receive this data; the recipient is Google. The SDK offers no way to switch this transmission off. Anyone wishing to avoid it can use the app without an internet connection – video creation works unchanged. 10. No User Tracking

Beat Motion Studio contains no advertising libraries, no tracking technologies and no behavioural observation tools. No user profiles are created and no data is used for advertising purposes. The only transmission of technical data to a third party is the ML Kit SDK's diagnostics function on Android described in section 9; it serves Google's debugging and usage measurement of the SDK, not advertising. This is declared to Apple in the app's PrivacyInfo.xcprivacy file and to Google in the Data safety section of the Google Play Console.

11. Permissions

iOS. Beat Motion Studio may request the following permissions:

• Photos (Read): Required to select videos from the media library.
• Photos (Write): Required to save the finished video mix to the camera roll.
• Apple Music / Media Library: Required to select a music track from the Apple Music library.

All permissions are managed by iOS and can be restricted or revoked in Settings under Privacy & Security.

Android. The Android edition needs considerably less. It permanently requests only:

• Internet: Required to download the overlay and music packs. Android classifies this as a normal permission; it is granted at install time and therefore does not appear in the permission list. Video creation itself works without an internet connection.
• Saving to the gallery (Android 8 and 9 only): On those older versions a write permission is still needed to place the finished video in the Movies folder. From Android 10 onwards it is no longer required.

No permission is requested for videos, photos or music: the user picks those files through the system's own dialogs, and the app sees only what was selected there. The storage permission on Android 8 and 9 can be reviewed and revoked in Android Settings under Apps → Beat Motion Studio → Permissions.

12. Rights of Data Subjects

Since Pondstack Software does not collect or process personal data in the normal operation of the app, the typical GDPR rights apply primarily to data stored on the user's own device — i.e., the user themselves.

To the extent that personal data is collected through email communication (e.g. support requests), you have the right under the GDPR to:

• Access your stored data (Art. 15 GDPR)
• Rectification of inaccurate data (Art. 16 GDPR)
• Erasure of your data (Art. 17 GDPR)
• Restriction of processing (Art. 18 GDPR)
• Data portability (Art. 20 GDPR)
• Object to processing (Art. 21 GDPR)

13. Right to Lodge a Complaint

You have the right to lodge a complaint with a competent data protection supervisory authority. The authority responsible for Pondstack Software is:

14. Data Security

Since all app data is processed and stored locally on the user's device, the user is responsible for its security. Pondstack Software recommends keeping the screen lock and device encryption enabled and performing regular backups (iCloud or computer on iOS, Google One or computer on Android).

15. Children

Beat Motion Studio is not specifically designed for children under 13 and is not directed at children. The app is rated 4+ in the Apple App Store; in the Google Play Store the rating determined by the Play questionnaire applies. Since Pondstack Software does not collect user data, there are no specific privacy risks for children from the app itself.

16. Changes to This Privacy Policy

This privacy policy may be updated in the event of significant changes to the app or legal requirements. The current version is always available at pondstack.com/beatmotionstudio-privacy.
