1. Provider and scope

These terms apply to the iOS application High Five Studio (the “App”) by Pondstack Software, represented by Jürgen Frosch, Segeberger Chaussee 162, 22851 Norderstedt, Germany (the “Provider”). By downloading, installing or using the App you agree to these terms. Apple's Standard Licensed Application End User License Agreement (EULA) applies in addition.

2. Description

High Five Studio creates short music videos (“Top 3” to “Top 5”) for social media: excerpts of 3 to 5 songs play one after another with text overlays (rank, artist, title, headline) and are exported as MP4. Features include camera recording with live titles, backgrounds (own photos/videos, animated loops, gradients, colors), “Remove my background” (on-device cut-out), templates, film looks, audio-reactive effects, transitions, and export in 9:16, 1:1 or 16:9. Video creation happens entirely on the device.

3. Free version

The App can be used for free: pick songs, record, design, render and watch the video full screen. Saving to Photos, sharing and “To Instagram” require PRO.

4. In-app purchase “PRO”

PRO is a one-time in-app purchase (non-consumable, no subscription) via the Apple App Store for €9.99 (Germany; prices in other regions may differ). PRO permanently unlocks saving and sharing finished videos. The purchase is tied to your Apple ID and can be reactivated via “Restore purchases”. Billing is handled by Apple; the Provider receives no payment data.

5. Refunds

Withdrawal and refunds are governed by Apple's terms. Please contact Apple directly (reportaproblem.apple.com).

6. License to the App

The App and its content (code, design, graphics, templates, bundled animated backgrounds) are protected by copyright. The Provider grants a simple, non-transferable right to use the App for private and commercial purposes. Decompiling, reverse engineering, reselling or modifying the App is prohibited. You may use videos created with the App, including the bundled backgrounds, in your social media posts.

7. Music and third-party content

You alone are responsible for holding the rights to the songs, images and videos you use and for being allowed to publish them. The App provides no music and grants no licenses. When publishing on platforms such as Instagram, TikTok or YouTube, their terms and music policies also apply. The Provider is not liable for infringements caused by content used by the user.

8. Liability

The Provider is fully liable for intent and gross negligence and for injury to life, body or health. Otherwise liability is limited to foreseeable damage typical for the contract. Uninterrupted, error-free availability is not guaranteed. No liability is accepted for loss of locally stored projects or videos due to device loss, system errors or iOS updates.

10. Changes to these terms

The Provider may amend these terms when the App or the law changes significantly. Continued use after a change constitutes acceptance.

11. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. Place of jurisdiction, where permitted, is Hamburg, Germany.

12. Severability

If any provision is invalid, the remaining provisions remain unaffected.
