§ 1 Provider

§ 2 Subject Matter

The subject matter is the provision of software products (DJReport, TrackHound, BPM Scout, SlippyClean, CrowdDrop, Spin Deck Studio, RekordTidy, Evermoment, High Five Studio). Depending on the product, the software serves for DJ setlist creation, music tempo detection, track identification, system maintenance, secure management of event photos, or the creation of short music videos for social media (High Five Studio: top-3 to top-5 reels made from songs, images and camera recordings provided by the user, created entirely on the device). Where lists or reports are generated, this is done based on the current requirements of collecting societies, in particular GEMA. No guarantee is given for the recognition or legal validity of individual submissions.

§ 3 Independence / Trademark Notice

Pondstack Software products operate independently and have no economic or organizational connection with Rekordbox, Serato DJ, GEMA, Instagram, TikTok, Spotify, Apple Music, or other named brands.

CDJ, XDJ, rekordbox and Pro DJ Link are trademarks of AlphaTheta Corporation. CrowdDrop is an independent product by Pondstack Software and is not affiliated with AlphaTheta or Pioneer DJ.

§ 4 Contract Formation / Apple

Purchases are made via the Apple App Store. Apple is not a contracting party for software use. Subscription management is handled exclusively through Apple. One-time in-app purchases (e.g. “PRO” in High Five Studio) are tied to the Apple ID and can be reactivated via “Restore purchases”. Where an app can be used for free, the purchase unlocks the features named in the product description (for High Five Studio: saving, sharing and publishing finished videos).

§ 5 User Content and Third-Party Rights

Where users process or publish their own content with the software (in particular music, images, videos and camera recordings, e.g. in High Five Studio), they alone are responsible for holding the necessary rights and for obtaining the consent of any persons shown. Pondstack Software provides no music and grants no licenses. When publishing on platforms such as Instagram, TikTok or YouTube, their terms and music policies also apply. Bundled content (e.g. templates and animated backgrounds) may be used in works created with the software, but may not be distributed on its own.

§ 6 Data Backup Obligation

The user is obliged to create adequate backup copies of their databases, music libraries, project files, and created videos before using the software.

§ 7 Liability

The following liability rules apply:

• Unlimited liability for intent, gross negligence, and personal injury
• Limited liability for slight negligence affecting material contractual obligations
• Liability for data loss is limited to restoration costs in the event of proper data backup
• Excluded: indirect damages (lost profits, cancelled events, reputational damage)
• No liability for format changes by third-party software or faulty exports

§ 8 Warranty

Statutory warranty rights for digital products apply. Future compatibility with third-party software is not guaranteed.

§ 9 Applicable Law

German law applies. Mandatory consumer protection provisions remain unaffected.
